Filipinos divorced from foreigners may now remarry???

I believe that this would be a good thing but is it a bill or has it already been made law, the title of the news article implies it is already law?  :-\

The measure also reportedly seeks to simplify the process for the recognition of foreign judgments on divorce obtained by the former spouses of Filipinos.

It reportedly amends Article 13 of Executive Order No. 209, or the Family Code of the Philippines, to read (Proposed amendments in italics): “Article 13. In case either of the contracting parties has been previously married, the applicant shall be required to furnish, instead of the birth or baptismal certificate required in the last preceding article, the death certificate of the deceased spouse or the judicial decree of the absolute divorce obtained by the alien spouse duly authenticated by the Philippine consul in the country where the decree was obtained, or the judicial decree of annulment or declaration of nullity of his or her previous marriage.”

“The Filipino spouse need not seek judicial recognition or enforcement of the foreign judicial decree of absolute divorce and its registration by the civil registrar shall be sufficient for the issuance of a marriage license,” it adds.

The bill also provides that, “Where a marriage between a Filipino citizen and a foreigner is validly celebrated and a judicial decree of absolute divorce is thereafter validly obtained abroad by the alien spouse, the Filipino spouse shall thereupon acquire the capacity to remarry under Philippine Laws.”

This is already allowed by the Family Code of the Phl.  However, currently you have to go to a Phl court to get the divorced recognised in the Phl.  It seems that this bill would only require approval of the divorce in a Phl Embassy or Consulate in the country where the divorce was obtained.

It's still good news because at least now, your ability to remarry isn't subject to a judge's whim or greed.

I look at the new law as a good thing, if it gets passed its just one more step to getting rid of the annulment process and will allow many here that can't afford an annulment a new freedom, you can eat the whole cake if you take little bites...

The Filipino/a can not be the originator of the divorce only the foreign spouse can.
